Villainous Reminder: Don’t Reveal Your Plans to Your Enemies…
…especially when they are taping you. A lesson learned too late for one false accuser.
By the way, how bat**** crazy do you have to be to convince your boyfriend to take the precaution of secretly taping a conversation with you?
Lord, stuff like that drives me crazy. It makes actual rape cases look like a joke. -.-

“It makes actual rape cases look like a joke.” I’m really hopeful that this one is a rare, rare exception. On the plus side, my uninformed guess would be that it’d be relatively easy to distinguish this from a legitimate rape accusation even if there hadn’t been a videotaped blackmail attempt.
–A medical examination would have revealed no signs of trauma, self-defense wounds or anything else that would indicate that the relationship was nonconsensual. (Even if she had been crazy enough to injure herself, a medical examiner might be able to conclude that the wounds were self-inflicted).
–I would imagine that a cursory probe into the accuser’s background would reveal some charges related to dishonesty, crazy outbursts and/or drug offenses. Very possibly some mental issues as well.
–If I were a defense attorney for the accused “rapist” here, I’d call up all of the accuser’s ex-boyfriends I could find. I’m pretty sure at least one would be willing to testify that she attempted to blackmail him. I’m guessing that pretty much all of them would be willing to testify to a pattern of egregious dishonesty. I’d want to VERY CAREFULLY call the accuser’s credibility into question, while keeping in mind that juries are understandably not very receptive to improper treatment of women that have very possibly been raped. PS: For reasons of optics, I definitely wouldn’t want a male attorney conducting this part of the cross-examination. (It’d probably look like the guy was bullying her).
–I’d go through any other police reports she filed. I’m guessing that they are, ahem,
less than forthright. (I’d be surprised if the police haven’t already looked into this possibility–if she has already perjured someone into prison, there will be hell to pay).
–If she actually had been raped by her boyfriend, I’d imagine that it’d be a bit unusual that she’d stick around in the apartment (with the boyfriend) and call the police significantly later. I’m not sure, though–people that really HAVE been abused sometimes act in ways that would seem implausible to people outside the situation.
–Hopefully the defendant doesn’t have a criminal record. Get as many people as possible–ideally ladies–that will vouch for his considerate, compassionate, friendly nature. I don’t think a real rapist would be able to get ex-girlfriends to serve as character witnesses.
–As a long-shot, I’d talk to the accuser’s friends. This criminal does not strike me as very smart, so she might have talked about it with friends. (Ahem–she was willing to talk about it with the victim). There are limits to what a friend could report about such a conversation (hearsay), but it’s possible that it could help anyway. “She told me she was making the whole thing up” would probably get struck down immediately as hearsay and could not technically be considered by the jury, but in actuality I think it’d push a wavering jury into an acquittal on all counts. (The judge can tell the jury to disregard the hearsay statement, but he can’t make them forget it).
In general, I think juries are naturally predisposed to believe possible rape victims (accusers) over possible rapists (defendants). But I don’t think that predisposition would be enough to overcome the lack of corroborating evidence here.
